Terms of Use

These terms govern the use of the NS Team Attendance app (iPhone, iPad and Android). By using the app you accept them. They are written to be clear: if something is not, write to us.

1. Who we are

The app is developed and provided by Nicola Salvaro (NS App Dev), VAT no. (P.IVA) 04592340238, Via Casotti 1754 int. 1, 37050 Isola Rizza (VR), Italy. Email: nscoachtools@gmail.com.

2. Who can use the app

The app is designed for coaches and sports clubs. You can use it without an account. To create a Premium account you must be at least 16 years old and sign in with your own Google or Apple account.

3. What the app offers

  • Free version, without an account: teams, athletes, sessions and attendance stored only on your device.
  • Premium: sign-in with Google or Apple, data stored in the cloud and synced across devices, sharing teams with other Premium users.

We may improve, change or remove features over time. If a change removes an essential Premium feature you have already paid for, we will tell you and you can ask for a proportional refund for the period not used.

4. Premium: purchase, duration and refunds

  • Premium can be purchased only inside the app, through the App Store or Google Play. Payment, receipts and payment details are handled by Apple and Google: we do not see them.
  • Premium lasts one year from the day after the purchase. It does not renew automatically: when it expires you can purchase it again. If you purchase it while it is still active, the new year is added to the current one.
  • The price is the one shown by the store at the time of purchase, in your currency and including taxes.
  • Premium is linked to your app account, not to the device or the store account.
  • Right of withdrawal: Premium is digital content supplied immediately after purchase. By purchasing it you ask for supply to start immediately and you accept that, for this reason, the 14-day right of withdrawal is lost once supply has begun, as provided by law (art. 59(o) of the Italian Consumer Code, implementing EU Directive 2011/83).
  • Refunds: these are requested from Apple or Google under their rules (Apple: reportaproblem.apple.com; Google Play: from your order history). If a purchase was paid but Premium was not activated, write to us: we will fix it.
  • When Premium expires, your data in the cloud is not deleted immediately: you find it again if you renew (see section 9 for inactive accounts).

5. Your account

You are responsible for the use of your account and of the Google or Apple account you sign in with. If you think someone is using it without permission, write to us. We may suspend or close an account used in breach of these terms or of the law, letting you know where possible.

6. Sharing teams

If you share a team with another user, that person sees the team, its sessions and attendance. You decide whether they can also edit attendance, and you can stop sharing at any time. Share only with people you trust and who are entitled to see that data (for example other coaches of the same club).

7. Your athletes' data

When you enter your athletes' data, you (or your club) are the data controller of that data: you decide which data to enter and why, and you are responsible for informing the athletes and, if they are minors, their parents, and for having a legal basis to do so.

When this data is in the cloud (Premium), we process it on your behalf as data processor (art. 28 GDPR), under the following conditions, which serve as the data processing agreement:

  1. we process the data only to provide you with the service and according to your instructions, that is, what you do in the app;
  2. anyone processing it on our behalf is bound by confidentiality;
  3. we take appropriate security measures (encrypted communications, access limited to the account and to the people you share with);
  4. we use Google (Firebase) as sub-processor, and you authorise us to do so. If we change sub-processor we will tell you through an update of these terms, and you can object by deleting the account;
  5. we help you answer requests from athletes (access, deletion, etc.) and handle any data breaches, which we report to you without delay;
  6. when you delete the account we delete the data, unless the law requires otherwise;
  7. we give you the information reasonably needed to show that these obligations are met.

The app only asks for the athletes' name and attendance. Do not enter any other data, in particular health data, reasons for absence or sensitive information.

8. Fair use

You may not use the app for illegal purposes, enter data about people without being entitled to, try to access other users' data, get around the Premium limits or the security systems, copy or modify the app, or upload offensive content.

9. Account deletion and inactivity

  • You can delete the account at any time from the app ("Delete user" on the first screen) or by following the instructions at https://nsappdev.com/team-attendance/delete-account. Deletion removes the account and the cloud data and cannot be undone.
  • By deleting the account you also lose any Premium still active, without a refund from us.
  • If you do not sign in for 24 months and your Premium has expired, we may delete the account and the data, warning you by email beforehand where possible.

10. Availability and updates

We do our best to keep the app working at all times, but we cannot guarantee an uninterrupted or error-free service, also because it depends on third-party services (Google, Apple, your connection). For security or compatibility reasons we may ask you to update the app before you continue using it. We recommend not keeping data that is essential to you only in the app.

11. Liability

We are liable for damage caused by our wilful misconduct or gross negligence and in all cases where the law does not allow liability to be limited. Otherwise, to the extent permitted by law, we are not liable for indirect damage or for data loss due to causes beyond our control.

If you are a consumer, nothing in these terms limits the rights the law gives you (in particular the legal guarantee of conformity for digital content and services).

12. Intellectual property

The app, its name, logo and content belong to Nicola Salvaro or their respective owners. We grant you a personal, non-exclusive and non-transferable licence to use it. The data you enter remains yours.

If you downloaded the app from the App Store, Apple's standard Licensed Application End User License Agreement also applies; in case of conflict, it prevails for matters concerning Apple.

13. Changes to the terms

We may update these terms, for example for new features or changes in the law. If the change is important we will point it out in the app and, where needed, ask you to accept it again. If you do not agree you can stop using the app and delete the account.

14. Governing law and disputes

These terms are governed by Italian law. If you are a consumer, the court of the place where you live has jurisdiction for disputes, and you can in any case rely on the protective rules of the country where you live. First of all, though, write to us: we always try to solve problems directly.
